These Terms of Service and End User License Terms govern your use of the TrackerSuite ecosystem, including the website, the web application at trackersuite.app, and related mobile applications such as BodyTracker.

In these Terms, "TrackerSuite", "we", "us", or "Provider" refers to Noah Schweizer. "You" or "User" refers to the person using the website, web application, mobile application, or related services.

2. Scope of These Terms

These Terms apply to all consumer use of TrackerSuite, including free features, paid subscriptions, cloud sync, account features, website access, mobile app usage, optional AI-assisted features, and related digital services.

TrackerSuite is currently intended for consumers only. You may not use TrackerSuite on behalf of a company, organization, or other legal entity unless we expressly agree otherwise in writing.

For iOS apps downloaded from the Apple App Store, Apple's Standard Licensed Application End User License Agreement applies in addition to these Terms. These Terms supplement Apple's Standard EULA for matters such as accounts, cloud sync, subscriptions outside the App Store, acceptable use, AI-assisted features, and service-specific rules. In case of conflict regarding the iOS app license, Apple's Standard EULA applies unless mandatory law requires otherwise.

3. Description of the Service

TrackerSuite provides digital tools for logging, tracking, organizing, syncing, and analyzing body metrics, fitness-related values, progress data, and nutrition-related information.

Features may include local tracking, cloud accounts, cross-device synchronization, dashboards, body metric calculators, progress charts, nutrition logs, subscription-based Pro features, and optional AI-assisted functionality.

We may update, improve, modify, add, or remove features over time, provided this does not unfairly disadvantage you or remove essential paid functionality without appropriate reason.

4. Eligibility and Minimum Age

You must be at least 16 years old to use TrackerSuite. By using TrackerSuite, you confirm that you are at least 16 years old and that you use the service as a consumer for personal purposes.

5. Account Registration and Security

Some features require a TrackerSuite Cloud Account. This includes cloud synchronization, web dashboard access, and optional AI-assisted features. You are responsible for providing accurate account information, maintaining access to your email address or login provider, and keeping your account secure.

You must not share your login credentials, misuse another person's account, attempt to bypass security measures, or use automated methods to overload or abuse the service.

You are responsible for activity that occurs under your account unless the activity was caused by our fault or by circumstances outside your reasonable control.

6. Local Mode, Cloud Sync, and Data Responsibility

Some app functionality may be available locally on your device without a cloud account. Local data is stored on your device and may be affected by device loss, app deletion, operating system behavior, backups, or local storage issues.

If you enable cloud sync or create a TrackerSuite Cloud Account, selected data may be synchronized with our cloud infrastructure so that it can be accessed across devices and through the web dashboard.

Optional AI-assisted features are not available in local-only mode. They require a TrackerSuite Cloud Account and an active request by you.

You are responsible for checking that important entries are accurate and for exporting or backing up important information where export features are available. We do not guarantee that the service will be uninterrupted, error-free, or permanently available.

7. Subscriptions, Payments, and Billing

TrackerSuite may offer free features and paid Pro features. Prices, billing intervals, included features, trial periods, and renewal terms are displayed before purchase.

  • App Store purchases: subscriptions purchased inside the iOS app are billed by Apple through your Apple ID and are subject to Apple's App Store terms, payment rules, cancellation flow, refund process, and price change notification rules.
  • Web purchases: subscriptions purchased through the website or web application are processed by Stripe or another displayed payment provider. Billing occurs in advance for the selected billing period unless stated otherwise.
  • Renewals: subscriptions may renew automatically unless cancelled before the end of the current billing period.
  • Price changes: We may change subscription prices from time to time. Price changes do not affect the current billing period that has already been paid. For existing subscriptions, price changes will apply no earlier than the next renewal period and only after reasonable prior notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
  • Cancellation: cancellation prevents future renewal but does not automatically refund the current billing period unless mandatory consumer law or the applicable platform rules require otherwise.
  • Failed payments: if payment fails or a charge is reversed, we may suspend or restrict access to paid features until payment is resolved.

8. Right of Withdrawal for EU Consumers

If you are a consumer in the European Union and purchase a paid digital service directly from us through the web, you generally have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period begins on the day the contract is concluded. To exercise your right of withdrawal, contact us at contact@noahschweizer.com with a clear statement that you wish to withdraw from the contract.

For digital content or digital services that are provided immediately, your right of withdrawal may expire early if you expressly consent that we begin performance before the end of the withdrawal period and you acknowledge that this causes you to lose your right of withdrawal once performance has started, where permitted by law.

Purchases made through Apple's App Store are handled by Apple. Withdrawal, cancellation, and refund requests for App Store purchases must be made through Apple's systems unless applicable law provides otherwise.

9. Health, Fitness, Nutrition, and Medical Disclaimer

TrackerSuite is a software tool for logging, organization, visualization, and estimation. It does not provide medical advice, diagnosis, treatment, therapy, nutritional counseling, or professional health recommendations.

Body fat calculations, calorie calculations, macro estimates, progress analytics, AI-assisted outputs, food recognition results, and other calculated values are estimates only and may be inaccurate, incomplete, outdated, or unsuitable for your individual situation.

Always consult a qualified physician, dietitian, or other professional before making significant health, nutrition, training, weight loss, or lifestyle decisions, especially if you have a medical condition, eating disorder history, are pregnant, take medication, or experience symptoms.

10. AI-Assisted and Automated Features

TrackerSuite includes or may include optional AI-assisted and automated features, such as nutrition estimation, food recognition, progress interpretation, data summaries, smart suggestions, or other LLM-based functionality.

AI-assisted features are only available if you create and use a TrackerSuite Cloud Account. They are optional. If you do not actively use an AI-assisted feature, no AI request is sent for that feature.

AI-assisted outputs are generated automatically and may be wrong, incomplete, outdated, misleading, or unsuitable for your individual situation. You must review and verify outputs before relying on them.

AI outputs are not medical advice, nutritional advice, fitness coaching, diagnosis, treatment, therapy, or professional guidance. You must not use AI outputs as the sole basis for health, nutrition, training, weight loss, medical, financial, or other important decisions.

We may limit, modify, suspend, or discontinue AI-assisted features where necessary for safety, legal compliance, cost control, abuse prevention, provider changes, technical reasons, or product quality.

11. OpenRouter and Model Providers

TrackerSuite uses OpenRouter as a technical provider for optional LLM / AI-assisted features. OpenRouter provides access to different AI models through a unified API and may route requests to selected third-party model providers.

When you actively use an AI-assisted feature, the content necessary to process your request may be transmitted to OpenRouter and, depending on the selected model or routing configuration, to the relevant model provider. This may include your prompt, selected context, generated response, model name, token usage, timestamps, and technical request metadata.

Different AI models and model providers may have different availability, restrictions, acceptable use rules, logging practices, retention rules, and output behavior. Access to a specific model may be changed, degraded, limited, suspended, or discontinued by OpenRouter, by a model provider, or by us.

You must not use AI-assisted features to generate unlawful, harmful, abusive, deceptive, infringing, medical-risk, or otherwise prohibited content. You also must not attempt to bypass safety systems, model restrictions, usage limits, geographical restrictions, or provider rules.

Your use of AI-assisted features may also be subject to OpenRouter's terms, applicable model provider terms, and additional technical or safety rules. If a provider restriction prevents us from offering a specific model or feature, we may switch, limit, or remove that model or feature.

12. Acceptable Use

You agree not to misuse TrackerSuite. In particular, you must not:

  • use the service for unlawful, harmful, abusive, fraudulent, or misleading purposes;
  • attempt to access accounts, systems, data, models, APIs, or infrastructure without authorization;
  • reverse engineer, scrape, overload, disrupt, or interfere with the service except where legally permitted;
  • upload malicious code, spam, or content that violates rights of others;
  • misrepresent your identity or payment information;
  • use TrackerSuite to provide medical, nutritional, coaching, or commercial services to others without our written permission;
  • use AI-assisted features to generate or request unlawful, harmful, abusive, deceptive, infringing, or high-risk content;
  • attempt to bypass usage limits, payment limits, safety restrictions, AI provider restrictions, or security measures;
  • use the service in a way that could damage, disable, overload, or impair TrackerSuite, its providers, or any connected model provider.

13. Suspension and Termination by Us

We may suspend, restrict, or terminate access to TrackerSuite if you materially breach these Terms, create security or legal risks, misuse the service, misuse AI-assisted features, fail to pay applicable fees, or use the service in a way that harms other users, us, our providers, OpenRouter, or model providers.

We may also suspend, restrict, or remove access to specific AI-assisted features or models if required by OpenRouter, a model provider, law, safety requirements, abuse prevention, technical limitations, or cost control.

Where reasonable, we will notify you before taking action and give you an opportunity to resolve the issue. Immediate action may be taken if necessary to prevent harm, comply with law, protect security, enforce provider rules, or stop abuse.

14. Termination and Account Deletion by You

You may stop using TrackerSuite at any time. You may delete your TrackerSuite Cloud Account through the app or web dashboard where this feature is available.

Account deletion is intended to delete your cloud account and associated cloud data, subject to technical backup retention and legal obligations such as tax, accounting, fraud prevention, abuse prevention, security, or dispute documentation.

Account deletion may also delete AI-related data stored in your TrackerSuite account, such as saved AI interactions or related metadata, if such data is stored by us. Data already processed by third-party providers may remain subject to their own retention rules, legal obligations, and technical deletion processes.

Deleting your account does not automatically cancel subscriptions managed separately by Apple or Stripe. You must cancel active subscriptions through the App Store subscription settings or the Stripe billing portal, depending on where you purchased the subscription.

15. Availability, Maintenance, and Changes

We aim to provide TrackerSuite reliably, but we do not guarantee uninterrupted access, permanent availability, or error-free operation. Downtime may occur due to maintenance, updates, provider outages, security incidents, technical failures, AI provider outages, model provider outages, rate limits, or circumstances outside our control.

AI-assisted features may be affected by third-party model availability, provider routing, rate limits, model changes, content filters, safety systems, pricing changes, or technical restrictions. We do not guarantee that a specific AI model, model provider, response quality, or response speed will always be available.

We may change, improve, limit, or discontinue features where necessary for product development, security, compliance, cost control, provider changes, model provider changes, or technical reasons. For paid features, we will avoid changes that materially reduce the value of your active subscription without appropriate reason or remedy.

16. Intellectual Property and License

TrackerSuite, including its software, design, branding, text, graphics, interfaces, databases, and other content, is protected by intellectual property laws. We retain all rights not expressly granted to you.

Subject to your compliance with these Terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use TrackerSuite for your own private consumer purposes. You may not copy, resell, sublicense, distribute, modify, or exploit TrackerSuite beyond what is permitted by law or these Terms.

17. User Content and Your Data

You remain responsible for the data, prompts, text, images, measurements, nutrition logs, health-related information, and other content you enter into TrackerSuite. You confirm that you have the necessary rights to upload, enter, sync, submit, or process such data.

You grant us the limited right to process your data only as necessary to provide, secure, maintain, and improve TrackerSuite, as described in our Privacy Policy and these Terms.

When you actively use AI-assisted features, you authorize us to process and transmit the necessary input, context, and metadata to OpenRouter and, where applicable, to selected model providers for the purpose of generating the requested output.

18. Third-Party Services

TrackerSuite may rely on third-party services such as Apple, Google, Supabase, Vercel, Stripe, Resend, OpenRouter, model providers, and analytics or telemetry providers. Your use of features connected to these providers may also be subject to their own terms, privacy policies, acceptable use rules, technical limitations, and availability.

OpenRouter and model providers are independent third-party services. They may change models, pricing, routing, safety rules, logging practices, output behavior, access restrictions, or availability. These changes may affect AI-assisted features in TrackerSuite.

We are not responsible for third-party services outside our reasonable control, but we select providers with care and use them only as necessary for the operation of TrackerSuite.

19. Apple App Store Terms

For iOS apps obtained through the Apple App Store, the following additional terms apply:

  • Apple is not a party to these Terms and is not responsible for TrackerSuite or its content.
  • Apple has no obligation to provide maintenance or support services for TrackerSuite.
  • In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app if applicable under Apple's rules. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
  • Apple is not responsible for addressing claims by you or third parties relating to the app, including product liability claims, legal compliance claims, consumer protection claims, or intellectual property claims.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms for iOS app usage and may enforce these Terms against you as such.
  • Your use of the iOS app must also comply with the App Store terms and Apple's Standard Licensed Application End User License Agreement.

20. No Warranties for Estimates, AI Outputs, and User Decisions

TrackerSuite may display calculations, projections, averages, trends, recommendations, summaries, AI-generated responses, or estimates. These outputs depend on user input, algorithms, device data, third-party sources, AI models, model providers, and assumptions that may be incomplete, outdated, or inaccurate.

AI-generated outputs may contain errors, hallucinations, unsafe suggestions, outdated information, or content that does not match your individual circumstances. You must independently review and verify outputs before relying on them.

You are responsible for reviewing your data, checking outputs, and making your own decisions. We do not guarantee the accuracy, completeness, suitability, health impact, training impact, nutritional correctness, availability, legality, or outcome of any calculation, estimate, chart, recommendation, or AI-assisted output.

21. Liability

We are liable without limitation for intent, gross negligence, injury to life, body, or health, and where liability cannot be limited under mandatory law.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations. Essential contractual obligations are obligations whose fulfillment makes proper performance of the contract possible and on whose compliance you may regularly rely. In such cases, liability is limited to foreseeable, typical damages.

We are not liable for damages caused by inaccurate user input, misuse, medical or nutritional decisions made without professional advice, reliance on AI-generated outputs, third-party provider outages, OpenRouter outages, model provider outages, model changes, rate limits, device loss, local data deletion, unsupported modifications, or events outside our reasonable control, except where mandatory law requires otherwise.

Nothing in these Terms limits your mandatory consumer rights.

22. Indemnity for Misuse

If you intentionally or unlawfully misuse TrackerSuite, misuse AI-assisted features, violate rights of others, violate applicable provider rules, or breach these Terms in a way that causes claims, losses, or costs, you may be responsible for resulting damages to the extent permitted by law. This does not apply where you are not at fault or where mandatory consumer protection law provides otherwise.

23. Governing Law and Consumer Protection

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer residing in another country, mandatory consumer protection laws of your country of residence remain unaffected where they cannot be contractually excluded.

24. Dispute Resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

25. Changes to These Terms

We may update these Terms from time to time, for example to reflect new features, AI-assisted features, legal changes, provider changes, model provider changes, security requirements, or business changes.

Changes to subscription prices will be communicated separately where required and will not apply retroactively to billing periods already paid.

The latest version will be available on this page. If changes materially affect your rights or paid features, we will provide reasonable notice where required. Continued use of TrackerSuite after the effective date of updated Terms means that the updated Terms apply, unless mandatory law requires a different process.
